50 years ago, Roe v Wade enshrined a right to abortion. Last year, an extreme right-wing Supreme Court overturned it. The conservative movement won’t stop until abortion is illegal everywhere. Here’s our plan to fight back. 

The next battleground

The Supreme Court’s decision in Dobbs moved the fight for abortion access to the states. In 2023, we’ve got our sights set on Wisconsin as the major battleground for abortion access. Wisconsin has an abortion ban on the books from 1849 and state courts haven’t ruled yet on whether it was enforceable. Abortion providers have suspended services in the state for fear of violating the law, which makes it a felony to perform an abortion at any stage of pregnancy, unless it’s to save the life of the pregnant person. Last year Democratic Attorney General Josh Kaul sued to block that state law. That case is currently winding its way through lower courts and will almost certainly end up in and the case is very likely to head to the Wisconsin Supreme Court, which currently has a 4-3 conservative majority. This April, Wisconsinites will be voting on one seat on the Court, which is currently held by a retiring ultra-conservative justice. Replacing her with a pro-choice justice would create a pro-choice majority on the Court, and potentially result in the Court striking down the 1849 abortion ban.

Fight Back at the Ballot Box

The conservative movement has spent decades building power at the local and state level to reach this very moment. A majority of Americans support a legal right to abortion, but we don’t see that overwhelming support reflected by our current elected officials. Building a progressive, pro-choice candidate pipeline, winning majorities in state houses, and confirming progressive judges will take time, but 2022 proved that there's a lot we can do right now to protect abortion rights in the near term and realize the promise of our democracy in the long term. The work doesn't stop in 2023.
